Why You Need Workers' Compensation Insurance?
As soon as you hire your first employee, you need the protection of workers' compensation insurance. Not only state laws require it, but the financial security of your business may depend on it.
Penalties for noncompliance.
There are significant penalties for employers who are required to carry WC benefits for employees but fail to do so. First, such failure is a second-degree misdemeanor. Second, upon a complaint filed by the Division, the employer may be prevented from employing person or conducting business until compliance is accomplished. Third, upon failure to show proof of insurance, a fine of $1,000 plus $100 for each day of noncompliance may be levied.

If you are in an industry, other than construction, and have four (4) or more employees, full-time or part-time, you are required to carry workers' compensation coverage (an exempted corporate officer does not count as an employee).
What Workers' Compensation Insurance Is ?
In short, employees relinquish their right to sue employers if they suffer some job–related injury or illness. But in return, employers agree to provide state–mandated benefits if employees suffer some job–related injury or illness.
What kinds of Employee Injuries are covered?
The law covers all accidental injuries and occupational diseases arising out of and in the course and scope of employment. This includes diseases or infections resulting from such injuries. The law also covers death resulting from such injuries within specified periods of time. Even if you do not think an injury is covered, you must still file the First Report of Injury or Illness (DWC-1) with your insurance carrier for determination of responsibility within 7 days of your first knowledge of the accident/injury.
